Warranty and Returns

1. Faulty, Damaged or Incorrect Goods
   1. 1. If you think there is something wrong with your Goods you must contact our Customer Services Team via email at returns@brooklandswatches.com or via telephone on +447507 703857. We honour our legal duty to provide you with Goods that are as described to you on our Website and that meet all the requirements imposed by law as explained below. For detailed information please visit the Citizens Advice website www.citizensadvice.org.uk. Remember too that you have several options for resolving disputes with us.
      2. The Consumer Rights Act 2015 says that goods must be of satisfactory quality, fit for purpose, as described at the time of purchase, in accordance with any pre-contract information we have provided, and that match any samples that you have seen (unless we have made you aware of any differences).
      3. During the expected lifespan of your product your legal rights entitle you to the following;
         1. 1. Up to 30 days: if your Goods are faulty or damaged, then you can get a refund.
            2. Up to six months: if your Goods can’t be repaired or replaced, then you’re entitled to a full refund, in most cases.
            3. Up to six years: you may be entitled to some money back.
      4. Any defect or non-conformity of Goods which becomes apparent within the 6 months of delivery are presumed to have existed at the time of delivery. After the expiry of this 6-month period and up to a limit of 6 years, the burden to prove that the defect or non-conformity of the Goods existed on delivery is your responsibility.
      5. If the Goods you have purchased do not comply and, for example, are damaged when you receive them, please contact us as soon as reasonably possible to inform us of the fault, damage or error, take a photograph of the damage, send to returns@brooklandswatches.com
      6. To return the Goods to us for any reason under this clause, please contact us to arrange for the return.  We will be fully responsible for the costs of returning the Goods under this clause and will reimburse you where appropriate.

1. Cancelling and Returning the Goods if You Change Your Mind
   1. 1. If you are a Consumer in United Kingdom, you have a legal right to a “cooling-off” period where you can change your mind about your purchase and receive a refund of what you paid for it, including the delivery costs where Goods have already been delivered.
      2. You cannot change your mind about an Order if the Goods were made to your specifications or are clearly personalised including but not limited to Goods that may have been engraved or embossed.
      3. If you change your mind about the Goods you must let us know no later than 14 calendar days after the day on which you (or someone you nominate) receive(s) the Goods or can do so anytime before we have processed the Order and arranged delivery.
      4. To let us know you want to change your mind, contact our Customer Service Team via email at returns@brooklandswatches.com or via telephone on +447507 703857 or fill in the online form. Cancellation by email is effective from the date on which you send us your message.

1. 1. 1. To return the Goods you must follow the following steps
         1. 1. contact our Customer Service Team via email at returns@brooklandswatches.com or by telephone on +447507 703857.
            2. You may choose to either use our pick-up service and agree on a pick-up date with our logistics partner or drop off the Goods at any of our logistic partner’s network location no more than 14 calendar days after the day on which you informed us of your wish to cancel.
            3. We will send you a return form by e-mail if one was not enclosed with the Goods when delivered.
            4. You must complete the form and seal the delivery package ensuring that the completed form along with the Goods, all its accessories, any free gifts you received as part of your Goods, the service guide, the warranty card and all other documents are in the original box and affix the prepaid delivery return label.
            5. Whether you have opted for the drop off service or for our logistics partner to pick-up the Goods, you will be given a receipt with a return tracking number that should be kept until we have confirmed to you that we have received the Goods.
      2. You have to return the Goods at your own cost unless we offered you free returns when you bought the Goods, and you may return the Goods to us by Royal Mail or another established delivery service of your choice.  If you do this you should keep a receipt or other evidence from the delivery service that proves you have sent it and when you sent it. We highly recommend you use recorded delivery or a similar premium service.
      3. If you don’t have your proof of delivery and we don’t receive the Goods at all or within a reasonable time we won’t refund you the price.
      4. Refunds will be issued to you within 14 calendar days from the day on which we receive the Goods back or informed us of your wish to cancel if the Goods have not yet been processed for delivery.
      5. Refunds may be reduced for any diminished value in the Goods resulting from your excessive handling of them. If you handle the Goods in a way which would not be acceptable in-store, we reduce your refund to compensate us for its reduced value. For example, we reduce your refund if the Goods condition is not “as new”, price tags or stickers have been removed, the Goods packaging is damaged, or accessories or documents are missing. In some cases, because of the way you have treated the Goods, no refund may be due.  Our Customer Service Team can advise you on whether we’re likely to reduce your refund.
      6. We will refund standard delivery charges in full as part of your refund.  However, we cannot refund any extra you have paid for express delivery or delivery at a particular time.
      7. Refunds will be made using the same payment method that you used when ordering the Goods.

Warranty

1. All our watches come with a 2-year guarantee at no added cost. If you choose to register for My Brooklands for your watch, you may qualify for an extended warranty.

   We guarantee the functioning of all watches for a period of two years from the date of purchase only if the watch has been sold by Brooklands Watch Company online or by an Official Brooklands Watch Company Retailer;

   Your guarantee won’t cover:

   • normal wear-and-tear
   • loss, theft, or damage due to misuse.
   • accidental damage, for example if your watch has been dropped. You may find that this type of damage is covered by your household contents insurance policy.
   • Cosmetic damage such as trim, scratches, dents, corrosion or colour where the function of the watch is unaffected

   The substitution of components with, or the addition of, components or accessories not manufactured by Brooklands Watch Company will invalidate the guarantee.

   The guarantee is only valid if:

   • the guarantee card has been completed in full by Brooklands Watch Company or a Official Retailer at the time of purchase;
   • the guarantee card is presented with the watch, either to Brooklands Watch Company or to an Official Brooklands Watch Company Retailer; and
   • any work has been carried out by Brooklands Watch Company. Work carried out by third parties will render the guarantee null and void.

   Nothing in this warranty is intended to or will limit your legal rights as a Consumer under any consumer protection legislation, where applicable. For more details of your legal rights, please refer to your local Citizens’ Advice Bureau or Trading Standards Office.

   Extended Warranty

   By registering for My Brooklands, you will have the opportunity to apply for an extension of the standard warranty by a further 36 months (the “Warranty Extension”). You can apply for the Warranty Extension at any time during your participation in My Brooklands whilst your original 2-year Brooklands Watch Company Warranty is still valid.

   Registration for My Brooklands is subject to our terms and conditions and privacy policy.

5. What Personal Data Do You Collect and How?

1. We may collect and hold some or all of the personal data set out in the table below, using the methods also set out in the table. We do not collect any ‘special category’ or ‘sensitive’ personal data or personal data relating to children or data
   relating to criminal convictions and/or offences.

1. Under the Data Protection Legislation, we must always have a lawful basis for using personal data. We are required to set out the legal basis for our ‘processing’ of your personal data.

10. How Can I Access My Personal Data?

1. If you want to know what personal data we have about you, you can ask us for details of that personal data and for a copy of it (where any such personal data is held). This is known as a “subject access request”.

2. All subject access requests should be made in writing and sent to the email or postal addresses shown in Clause 12.

3. There is not normally any charge for a subject access request. If your request is ‘manifestly unfounded or excessive’ (for example, if you make repetitive requests) a fee may be charged to cover our administrative costs in responding.

4. We will respond to your subject access request within 5 working days and, in any case, not more than one month of receiving it. Normally, we aim to provide a complete response, including a copy of your personal data within that time. In some cases,
   however, particularly if your request is more complex, more time may be required up to a maximum of three months from the date we receive your request. You will be kept fully informed of our progress.

Website Sales Terms and Conditions

These terms and conditions together with our Privacy Policy, Refunds Policy, Delivery Policy and Warranty tell you information about us and constitute the legal terms and conditions ('Terms') on which we sell any of the goods ('Goods') listed on our website (and all associated pages) ('Website') to you.

www.brooklandswatches.com  is operated by Brooklands Watch Company Limited. Any references to "we", "us", or similar terms are a reference to this entity.

By making a purchase with us, you are agreeing to the Terms, and it is your own responsibility to ensure that you are fully aware of these.

1. Our Contract With You
   1. 1. These Terms and Conditions govern the sale of all Goods by us and will form the basis of the Contract between you and us.  If you wish to place an order for the Goods with us (“Order”), our Website will guide you through the ordering process. 
      2. Our Website will give you the opportunity to either checkout as a guest, register or if already registered, login.
      3. Before submitting your Order to us, you will be given the opportunity to review and amend it.  Please ensure that you have checked your Order and that you have read these Terms and Conditions carefully before submitting it, ticking the box to say ‘I have read and understood the terms & conditions’ and making payment.  If you are unsure about any part of these Terms and Conditions, please ask us for clarification.
      4. No part of our Website constitutes a contractual offer capable of acceptance.  Your Order constitutes a contractual offer that we may, at our sole discretion, accept. 
      5. Upon receipt of your Order, we will send you an acknowledgement of your Order to you by email (“Order Acknowledgement”); this is NOT contractual acceptance of our ability to provide this product, it is an acknowledgement that we have received your offer, and should the Goods be available as detailed on our Website then you have entered into a legally binding agreement to purchase the Goods.
      6. Once we have received confirmation that the Goods are available and payment has been authorised, we will contact you via email to let you know that your order has been processed for delivery. (“Delivery Confirmation”)
      7. Our acceptance is indicated by us sending you a Delivery Confirmation by email.  Only once we have sent you a Delivery Confirmation will there be a legally binding contract between you and us (“Contract”).  Delivery Confirmations will be provided in writing and will contain the following information:
         1. 1. Confirmation of the Goods ordered with fully itemised pricing including, where appropriate, taxes, delivery and other additional charges;
            2. An Order number to be used in any future correspondence
            3. Our identity and contact details;
            4. The estimated delivery date(s) and time(s).
      8. It is your responsibility to provide the correct email address upon placing an order. We cannot take responsibility for the non-delivery of an acknowledgement or dispatch email should your email address be incorrect.
      9. Sometimes with reject orders, for example, because a product is out of stock, because you are located outside of the UK or because there was a pricing error on our website. If we, for any reason, do not accept or cannot fulfil your Order, and we have taken payment, any such sums will be refunded to you as soon as possible (in any event, within 14 days).
      10. Once your Order has been accepted as detailed in clause 1.5, it is your responsibility to notify us of any incorrectly entered order details during checkout.

1. Description and Specification of Goods
   1. 1. We have made every reasonable effort to ensure that the Goods conform to the photographs and descriptions provided in our sales and marketing literature and on our Website.  We cannot, however, guarantee that all photographs and descriptions will be precisely accurate.  Please note in particular that certain colours when displayed on your computer, phone or tablet may look different to the actual colour of the Goods.
      2. We reserve the right to make any changes in the specification of the Goods that may be required to conform to any applicable safety or other legal or regulatory requirements, without notice.
      3. We neither represent nor warrant that particular Goods will be available.  Stock indications are not provided on our Website.  If the Goods are not available, and the waiting time is not convenient for you, the provisions of clause 1.9 will apply.

1. Price and Payment
   1. 1. The price of the Goods will be shown on our Website at the time of your Order.  Our prices may change at any time but these changes will not affect any Orders that we have already accepted.
      2. The price of the Goods does not include delivery charges, which will be notified to you during the checkout process and before you confirm your order.
      3. We have made every reasonable effort to ensure that our prices, as shown on our Website are correct.  If we find, or are made aware of, any typographical, clerical or other accidental errors or omissions in our sales and marketing literature or on our Website, we will make every reasonable effort to correct such errors or omissions as soon as is reasonably possible.  We will normally check prices as part of our despatch procedures so that:
         1. 1. where the Goods' correct price is less than the price stated on our Website, we will charge the lower amount when despatching the Goods to you; and
            2. if the Goods' correct price is higher than the price stated on our Website and/or your Order Acknowledge, we will contact you as soon as possible to inform you of this error and we will give you the option of continuing to purchase the Goods at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing. If the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we will be under no obligation to provide the Goods to you at the incorrect (lower) price.
      4. All prices include VAT, where applicable.  If the rate of VAT changes between the date of your Order and the date of your payment, we will adjust the rate of VAT that you must pay.  Changes in VAT will not affect any prices where we have already received payment in full from you.
      5. From time to time we may send promotional codes to our customers via email. These promotional codes may be subject to certain conditions of use and/or restrictions (including specific dates between which they may be applied), which will be specified at the time of issue.
      6. Promotional codes have no monetary value and must not be sold or transferred to anyone else.
      7. Promotional codes cannot be used in conjunction with any other offer. 
      8. All payments made via the Website will go through a secure payment gateway.  We accept Visa Credit, Visa Debt, American Express and MasterCard. No credit or debit card information is provided to us and completion of the transaction will be subject to you agreeing to third parties’ terms and conditions. A separate contractual relationship is created between you and them and we cannot be held liable for any errors, actions, omissions or incorrect charges that may be made by them.
      9. We do not accept liability if delivery of Goods is delayed because you have provided us with incorrect payment or delivery details.
      10. If it is not possible to obtain payment for the Goods using the payment details you have provide, your order will be rejected.

We may cancel your Order at any time before we despatch the Goods to you, if the Goods are unexpectedly no longer in stock and we are unable to re-stock (if, for example, the Goods are discontinued); because the Goods were mispriced by us or If an event outside of our control occurs (please see clause 6 for events outside of our control).
      2. If we cancel your Order and you have already paid for the Goods under clause 3, the payment will be refunded to you within 14 days.  If we cancel your Order, the cancellation will be confirmed by us in writing.

1. Your Legal Rights
   1. 1. If you buy online, by mail order or over the telephone, you have a legal right to change your mind, and a legal right regarding faulty, damaged or incorrect Goods. Further details of your rights are set out in our Refunds Policy which forms part of the contract between you and us.

1. Our Liability
   1. 1. Nothing in these Terms and Conditions seeks to exclude or limit our liability for death or personal injury caused by our negligence (including that of our employees or sub-contractors); or for fraud or fraudulent misrepresentation.
      2. All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from the Contract.
      3. Subject to sub-clauses 5.1 and 5.2:
         1. 1. We shall be under no liability in respect of any defect arising from fair wear and tear, or any wilful damage, negligence, subjection to improper conditions, failure to follow our instructions (whether given orally or in writing), misuse, attempted repair or alteration of the Goods without our prior approval, or any other breach of these conditions or act or omission on the part of the Customer, its employees or agents or any third party;
            2. our total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of the Contract shall be limited to the Contract Price; and
            3. we shall not be liable to you for any pure economic loss, loss of profit, loss of business, depletion of goodwill or otherwise, in each case whether direct, indirect or consequential, or any claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with the Contract.
      4. Nothing in these Terms and Conditions seeks to exclude or limit any of your rights as a Consumer where applicable.  More information on your rights as a Consumer can be obtained from your local Citizens’ Advice Bureau or Trading Standards Office.

1. Events Outside of Our Control (Force Majeure):  If our supply of the Goods is delayed by an event outside of our control such as power failure, internet service provider failure, industrial action, civil unrest, infectious diseases, fire, flood, storms, earthquakes, subsidence, acts of terrorism or war, governmental action, epidemic or other natural disaster, or any other event that is beyond our control, then we will contact you as soon as possible to let you know and do what we can to reduce the delay. As long as we do this, we won’t compensate you for the delay, but you can Customer Service Team via email at returns@brooklandswatches.com or by telephone on +447507 703857 to end the contract and received a full refund for any Goods you have paid for in advance, but not yet received.

We always welcome feedback from our customers and, whilst we always use all reasonable endeavours to ensure that your experience as a customer of ours is a positive one, we nevertheless want to hear from you if you have any cause for complaint.  If you wish to complain about any aspect of your dealings with us, please contact us in writing so we can investigate.

   1. 1. All personal information that we may collect will be collected, used and held in accordance with the provisions of the Data Protection Act 2018 and General Data Protection Regulations 2016 and your rights under that Act.

We may use your personal information to provide our Goods and services to you, process your payment for the Goods, send our newsletter to you; and/or inform you of new Goods available from us.  You may request that we stop sending you this information at any time.  We will not pass on your personal information to any third parties without first obtaining your express permission.

1. Other Important Terms
   1. 1. The Contract is between you and us.  It is not intended to benefit any other person or third party in any way and no such person or party will be entitled to enforce any provision of these Terms and Conditions. 
      2. If any of the provisions of these Terms and Conditions are found to be unlawful, invalid or otherwise unenforceable by any court or other authority, that/those provision(s) will be deemed severed from the remainder of these Terms & Conditions and the remainder will be valid and enforceable.
      3. No failure or delay by us in exercising any of our rights under these Terms and Conditions means that we have waived that right, and no waiver by us of a breach of any provision of these Terms and Conditions means that we will waive any subsequent breach of the same or any other provision.
      4. These Terms and Conditions and the Contract between you and us will be governed by, and construed in accordance with, the laws of England and Wales and any dispute will fall within the non-exclusive jurisdiction of the courts of England and Wales.

Delivery

1. 1. Delivery
      1. 1. Delivery charges are not included in the price of the Goods on our Website unless otherwise stated at the time of purchase.  Delivery options and any related charges will be presented to you as part of the Order process, where applicable. Payment for the Goods and any related delivery charges must always be made at the time of Order and you will be prompted to pay during the Order process.
         2. All Goods purchased through our Website will normally be despatched within 7 working days after the date of our Delivery confirmation unless otherwise agreed or specified during the Order process (subject to delays caused by events outside of our control - see clause 6 in main terms and conditions). 
         3. UK customers who have placed an Order may be required to sign for the Goods if you have chosen the sign for option.  Should your Order not arrive by the estimated delivery date, you should contact us in writing as soon as possible so we can investigate.
         4. It is your responsibility to provide us with full and correct delivery address details.  If your Goods are returned to us due to an incorrect or incomplete address, you will be charged the full delivery cost to re-deliver your order to a corrected address
         5. If no one is available at your delivery address to receive the Goods and the Goods cannot be left in a safe place nominated by you, the courier will leave a delivery note explaining how to rearrange delivery or where to collect the Goods.
         6. As per the courier’s terms if you do not collect the Goods or rearrange delivery within the time frame stipulated, we will contact you to ask you how you wish to proceed.  If we cannot contact you or arrange redelivery or collection, we will treat the Contract as cancelled and recover the Goods.  If this happens, you will be refunded the purchase price of the Goods themselves, but not the cost of delivery.  We may also bill you for any reasonable additional cost that we incur in recovering the Goods.
         7. In the unlikely event that we fail to deliver the Goods within 30 calendar days of our Order Acknowledgement (or as otherwise agreed or specified as under clause 1.1 of this Delivery Policy), you may treat the Contract as being at an end immediately if:
            1. 1. We have refused to deliver your Goods; or
               2. In light of all relevant circumstances, delivery within that time period was essential; or
               3. You told us when ordering the Goods that delivery within that time period was essential.
         8. If you do not wish to cancel under clause 1.6 or none of those circumstances apply, you may specify a new (reasonable) delivery date.   If we fail to meet the new deadline, you may then treat the Contract as being at an end.
         9. Delivery will be deemed to have taken place when the Goods have been delivered to the delivery address indicated in your Order and you (or someone identified by you) have taken physical possession of the Goods.
         10. The responsibility (sometimes referred to as the “risk”) for the Goods remains with us until delivery is complete as defined in clause 1.9, at which point it will pass to you.  You own the Goods only once we have received payment in full of all sums due (including any applicable delivery charges).
   1. International Delivery
      1. 1. We are able to ship internationally, subject to payment of any applicable delivery costs and subject to the following:
         2. However, if we agree to;
            1. 1. your order may be subject to import duties and taxes which are applied when the delivery reaches that destination.
               2. you will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before ordering any Goods from us.
               3. you must comply with all applicable laws and regulations of the country that the Goods are being delivered to. We will not be liable or responsible if you break any such law
